NOTICE OF YOUR FINANCIAL PRIVACY RIGHTS

At Silverleaf Resorts, protecting your privacy is very important to us.  We want you to understand what information we collect and how we use it.  We will collect personally identifiable financial information ("nonpublic personal information") about you, our customers and potential customers, from your applications, lead slips, and the documents we use to permit you to purchase and use a Vacation Interval or other resort service from us. "Nonpublic personal information" does not include any information which may be obtained from public sources, such as telephone directories or real estate records. This information may be disclosed to our affiliates and non-affiliates.  "Affiliates" are those companies we own or control, or that own or control us or that are owned by another company who owns or controls us. Of course, non-affiliates are all other entities. We reserve the right to modify our privacy policies upon written notification to you.

WHAT INFORMATION DO WE COLLECT?

We typically collect three types of nonpublic personal information and categorize that information as follows:

*              “Email Contact Information” which includes your name and your email address.

*              “Lead Slip Information” which includes all information we receive from the “Enter to Win” cards and other lead slips submitted by consumers in connection with our various marketing initiatives.  Lead Slip         Information is information such as your name, address, email address, cellular telephone number, home telephone number, demographical information (such as your age, marital status and employment status) and general information concerning your household income.

*              “Owner Information” which includes (1) information we receive from you on loan applications and other forms or documents submitted to us in connection with the purchasing or ownership process; (2) information about your bank accounts, personal loans and credit cards; (3) information we receive from a consumer reporting agency or other financial institution, such as your credit history; and (4) information about your transactions with us, our affiliates or others, including information concerning your account balance and payment history.

TO WHOM WILL WE DISCLOSE YOUR INFORMATION?

We may disclose your nonpublic personal information as follows:

*              Email Contact Information - we may disclose your Email Contact Information to:

**           our employees who have a need to access the information to provide services to you;

**           affiliated companies and non-affiliated third parties that perform marketing services or other processing and servicing transactions on our behalf.  By way of example, we will disclose nonpublic personal information to non-affiliated third parties to maintain accounts, respond to court orders and legal matters or report to credit bureaus.  In addition, we will disclose nonpublic personal information to non-financial mailing companies that mail marketing pieces on our behalf; and

**           non-affiliated third parties who may elect to market their products and services to you using your nonpublic personal information.  This information may be disclosed to non-affiliated third parties for marketing purposes unless you elect to “opt-out” of permitting us to share your nonpublic personal information by checking the box we provide for this purpose at the time we collect the Email Contact Information from you.  Typically, the non-affiliated third parties that receive your Email Contact Information are “venue specific” such as car dealerships, shopping malls, sporting venues and others who have provided a product or service in connection with one of our marketing initiatives at a particular venue (such as the right to display their vehicle at such venue or the right to establish a kiosk in such venue).  We generally do not receive any money in connection with the disclosure of Email Contact Information to venue specific third parties, but instead provide your information in exchange for the product or service provided to us.  We reserve the right to share your Email Contact Information with other non-affiliated third parties to the extent permitted by applicable law.

*              Lead Slip Information - we may disclose your Lead Slip Information to:

**           our employees who have a need to access the information to provide services to you;

**           affiliated companies and non-affiliated third parties that perform marketing services or other processing and servicing transactions on our behalf.  By way of example, we will disclose nonpublic personal information to non-affiliated third parties to maintain accounts, respond to court orders and legal matters or report to credit bureaus.  In addition, we will disclose nonpublic personal information to non-financial mailing companies that mail marketing pieces on our behalf; and

**           non-affiliated third parties who may elect to market their products and services to you using your nonpublic personal information.  This information may be disclosed to non-affiliated third parties for marketing purposes unless you elect to “opt-out” of permitting us to share your nonpublic personal information by checking the box we provide for this purpose at the time we collect the Lead Slip Information from you. Typically, the non-affiliated third parties that receive your Lead Slip Information are not “venue specific” but instead have a contractual relationship with us requiring (or permitting) us to disclose your Lead Slip Information to them for a fee or a right to receive something else of value from them.  We reserve the right to share your Lead Slip Information with other non-affiliated third parties to the extent permitted by applicable law.

*              Owner Information - we may disclose your Owner Information to:

**           our employees who have a need to access the information to provide services to you; and

**           affiliated companies and non-affiliated third parties that perform marketing services or other processing and servicing transactions on our behalf.  By way of example, we will disclose nonpublic personal information to non-affiliated third parties to maintain accounts, respond to court orders and legal matters or report to credit bureaus.  In addition, we will disclose nonpublic personal information to non-financial mailing companies that mail marketing pieces on our behalf.

WHEN DO WE DISCLOSE YOUR INFORMATION?

*              Email Contact Information - If we disclose your Email Contact Information to non-affiliated third parties for marketing purposes, it is our common practice to disclose it promptly upon receipt.

*              Lead Slip Information - If we disclose your Lead Slip Information to non-affiliated third parties for marketing purposes, it is our common practice to:

**           disclose all of the nonpublic personal information we collect if and when we determine that you do not meet our marketing criteria; and/or

**           disclose all of the nonpublic personal information we collect if you do not agree to attend a sales presentation within approximately sixty (60) days after we contact you.

*              Owner Information - We do not disclose the nonpublic personal information of our current or former owners, except as permitted by law and consistent with the above.  

In all cases, we restrict access to nonpublic personal information about you to those employees who need to know such information to provide services to you. We maintain physical, electronic and procedural safeguards that comply with federal regulations to guard your nonpublic personal information.
